These Terms & Conditions (“Terms”) govern your use of Fairegrowthagency.com and your purchase or use of services from Faire Growth Agency (“Company,” “we,” “us,” “our”). By using our website or services, you agree to these Terms.
1) Services
We provide consulting and managed services related to Faire and wholesale growth (the “Services”). Service scope, timelines, and deliverables are described in your proposal, invoice, checkout page, or written agreement.
2) No Guarantees / Results Disclaimer
You understand and agree that results are not guaranteed. Performance depends on many factors outside our control, including category competition, pricing, product-market fit, inventory availability, seasonality, marketplace changes, and the speed/quality of client execution. Any examples, case studies, or projections are illustrative and do not promise future results.
3) Client Responsibilities
You agree to:
Provide accurate information and timely approvals
Maintain inventory, fulfillment capacity, and customer response processes
Handle day-to-day high-touch sales functions unless explicitly agreed otherwise (including buyer messages, order acceptance, and negotiations)
Provide access to necessary accounts/tools and assets needed to perform Services
4) Payments, Fees & Billing
Fees are stated in your proposal/invoice/checkout page.
Payments are due in advance unless otherwise stated.
Late payments may result in paused work until the account is current.
You are responsible for any taxes associated with the purchase where applicable.
5) Term, Renewal, and Cancellation
If you purchase a plan with a minimum term (such as a 3-month commitment), you agree to that minimum term.
After the minimum term, services may continue month-to-month unless either party cancels with 30 days’ written notice via email to fairegrowthagency@gmail.com.
We reserve the right to terminate services for non-payment, abuse, or repeated failure to provide required access/materials.
6) Refund Policy
Unless otherwise stated in writing, all fees are non-refundable. Because services involve time, strategy, and execution, we do not offer refunds for partially completed periods.
7) Intellectual Property
We retain ownership of our frameworks, methods, templates, and internal tools used to provide Services.
Upon payment, you receive a limited, non-transferable license to use deliverables created for you for your business use.
You may not resell, redistribute, or publish our materials without written permission.
8) Confidentiality
Both parties agree to keep non-public business information confidential, including strategies, pricing, customer information, and account performance data, unless required by law or agreed to in writting.
9) Third-Party Platforms
Your use of third-party platforms (including Faire, Shopify, and email tools) is governed by their terms. We are not responsible for outages, policy changes, account restrictions, or platform decisions.
10) Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim related to the Services will not exceed the amount you paid to us in the 30 days before the claim arose.
11) Indemnification
You agree to indemnify and hold us harmless from claims arising out of your products, business operations, customer disputes, or your misuse of the Services.
12) Dispute Resolution
If a dispute arises, both parties agree to attempt good-faith resolution first. If unresolved, disputes will be handled in the state or federal courts located in California, and you consent to jurisdiction and venue in those courts.
13) Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
14) Changes to Terms
We may update these Terms from time to time. Continued use of the website or Services after updates means you accept the revised Terms.
